Short term residential tenancies.
If you hold a short term assured tenancy or an assured shorthold tenancy – do you have a problem with your rent arrears and/or your rental accommodation? For example, damp or mould or disrepair of the rented premises? Have you been given notice to quit the rental property by your landlord? You might be a short term tenant with a claim for damages for disrepair of the rented property, for inconvenience and/or distress. Tennyson barristers can advise you on your legal rights whether you rent out property as a private landlord or are such a tenant. Equally you may be a secured tenant under the Housing Act 1985 in a local authority property with similar issues or a local authority seeking possession of your rented property. Once again we are here to help.
Long term residential tenancies.
For long leaseholders we can advise both long leaseholders or their landlord. Currently there are many claims coming forward as a result of the Building Safety Act 2022. Where long leaseholders are receiving large service charge bills for replacement of cladding or for other remedial work. Landlords may also include other remedial work in the service charge for fire safety. As a tenant you may wish to know what your legal rights are to dispute such service charges. Are they payable under your lease? Who is responsible under your lease for payment for the fire safety remedial work? If you took the matter to the First Tier Tribunal (Property Chamber) who would pay the legal costs?
These are questions upon which we can provide you with legal advice amongst other matters. If you are a landlord you may be seeking to forfeit the long lease for rent arrears or for breach of covenant. Again we can assist you with a wealth of experience in landlord and tenant law on these matters.
Freehold residential property disputes.
If you are a property owner you may have a boundary dispute, an adverse possession claim, a breach of restrictive covenant(s), or an easement dispute. Such as an easement dispute over a right to light, right of way, right of support, right of water, right of fencing or a party wall matter. You may wish to access neighbouring land you do not own to carry out maintenance to your own land. Tennyson Counsel can advise you of your legal rights in these matters.
